YogaByEkta LLC (“we”, “us” or “our”) values your privacy. In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information that we obtain about visitors to our website at www.yogabyekta.com (the “Site”) and the services available through our Site and our mobile application (“App”) for accessing our yoga instruction and training (“Training”) and interacting with yoga Teachers (“Teachers”) (collectively, the App and services will be referred to as the “Services”), and how we use and disclose that information.
By visiting the Site, or using any of our Services, you agree that your personal information will be handled as described in this Policy. Your use of our Site or Services, and any dispute over privacy, is subject to this Policy and any applicable Terms of Use, including their applicable limitations on damages and the resolution of disputes.
Please note that one of the features of the Services is recording of Training sessions. These recordings are only shared with you and your Teacher and internally with our staff, and are not made public by us. Please see Recording of Training and Sessions for more information.
The Information We Collect About You
We collect information about you directly from you , as well as automatically through your use of our Site, App or Services.
Information We Collect Directly From You. You may browse certain areas of the Site without registering with us or providing us personal information. If you register as a user of our Services, such as using our App and obtaining Training, then you must create an account and provide your name and email address. You will also be able to create a password profile when using the App to participate in Training. We also collect other information as part of providing the Training and other Services, including your gender, years of yoga experience, types of yoga practiced, goals for practicing yoga, medical conditions, surgeries, credit card information (including address associated with your credit card for payment purposes), and ratings and reviews you provide on Teachers.
We may also collect your name and email address and other contact information if you sign up for our email newsletter or updates or if you contact us regarding our Site and Services.
Recording of Training and Sessions. The Services are interactive in that they enable you to connect in real-time to Teachers and for Teachers to connect with you to provide Training (the “Sessions”). These Sessions are recorded for both you and the Teacher to refer to in developing future Session plans and yoga training. Session recordings are only viewable by the Teacher that conducted that Session and are not available to other Teachers. Teachers may only use the Session recordings they conducted for teaching training and improvement, and for developing future Session planning with you. Teachers may not disclose or use the Session recordings for any other purpose.
In addition, our internal staff may view Session recordings for review relating to the quality of the Training and for customer service and support, and for development of Teacher training, but actual clips of the recordings would not be shown to other Teachers in connection with such training without your permission. If you do not want a Teacher to view your Training Session recording or want us to delete your Training Session recording, please contact us at ekta@yogabyekta.com
Information We Collect Automatically. We may automatically collect the following information about your use of our Site or Services through cookies and other technologies: your domain name; your mobile device type and ID; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site and or use our Services; and the referring URL, or the webpage that led you to our Site. We may combine this information with other information that we have collected about you, including, where applicable, your user name, name, and other personal information Please see the section “Cookies and Other Tracking Mechanisms” below for more information.
How We Use Your Information
We use your information, including your personal information, for the following purposes:
To provide our Site and Services to you, to communicate with you about your use of our Site and Services, to respond to your inquiries, to fulfill your requests, and for other customer service purposes.

Other Users of Our Services. We do not disclose your personal information to other users of the Services (except your Teacher) without your permission; however, if you post a review or rating of a Teacher such information will be viewable by other users of the Site or Services.
Service Providers.We may disclose the information we collect from you to third party service providers, contractors or agents who perform functions on our behalf, provided that they comply with the terms of this Privacy Policy. For example, we use Zoom / Google Meet / Jiomeet / skype for videoconferencing, whatsapp for business for chat, and Paypal for payment processing.
Business Transfers.If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.
In Response to Legal Process.We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a subpoena.
To Protect Us and Others.We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Policy, or as evidence in litigation in which we are involved.

We may permit users to submit their own content to our Site and Services, including, without limitation, Session recordings, videos, pictures, reviews, comments and other text. We are not responsible for the privacy of any information that you choose to submit through our Site and Services or for the accuracy of any information contained in those postings. If you post reviews or other content on public areas of our Sites or Services, such information will be viewable by other persons and users of the Services (as noted above, Sessions recordings are not posted by us publicly).
Location of Information
Our Site and Services are intended for use for users located and resident in the United States and Canada, and for Teachers primarily in India. Please personal information that is provided to us will be stored in various locations, including the United States. ] Please note that if you access or use the Site or Services from outside the United States, you assume all risk of doing so and are consenting to the transfer of your personal information to the United States, which may offer less protection to your personal information that your jurisdiction of residence.
Third-Party Links
Our Site and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third party websites. We are not responsible for the information practices of such third party websites.
Security of My Personal Information
We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.
You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
Access to My Personal Information
You may request modification of personal information that you have submitted to us by contacting us at ekta@yogabyekta.com or by updating your profile in your account. Requests for access and deletion of your personal information will be accommodated to the extent required by applicable law, provided that any deletion of your personal information may impact your ability to access and use the Services. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site for a period of time.
What Choices Do I Have Regarding Use of My Personal Information?
We may send periodic promotional or informational emails to you. You may opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.
Children Under 13
Our Site and Services are not designed for children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information from our systems.
